These terms explain how website use, pricing, orders, payment, delivery and product responsibilities work when you shop with ZINSON.

About these terms

This website and the ZINSON store are operated by David Bowles, sole trader, ABN 36 645 685 720, of 10 Literary Way, Williamstown VIC 3016, Australia. In these terms, “ZINSON”, “we”, “us” and “our” refer to that business.

By using the website or submitting an order, you agree to these terms, the Privacy Policy, Delivery Information and Returns & Refunds Policy. Nothing in these terms excludes a right or remedy that cannot lawfully be excluded.

Using the website

You must use the website lawfully and must not interfere with its security, availability or operation; use automated systems to scrape, overload or misuse it; submit false information; impersonate another person; or use content in a way that infringes rights.

Account credentials are your responsibility. Tell us promptly if you believe an account or order has been used without authority.

Products and website information

We take reasonable care with descriptions, dimensions, compatibility, stock and images. Colours can vary by screen, dimensions may be approximate and lifestyle images may show accessories not included. Packaging and minor product details can change.

Before ordering, check the written inclusions, measurements, access requirements and manufacturer instructions. Website content is general product information and is not professional building, electrical, gas, pool-safety or installation advice.

Orders and acceptance

  1. You submit an orderThis is an offer to buy the listed products under these terms.
  2. We acknowledge itAn automated receipt confirms we received the order; it does not necessarily mean acceptance.
  3. We review itStock, price, payment, fraud and delivery details may be checked.
  4. We accept or declineAcceptance occurs when we expressly accept or dispatch the order. If declined after payment is captured, the amount will be refunded.

We may decline or cancel before acceptance where stock is unavailable, a material price or description error occurred, payment is not authorised, delivery cannot reasonably be arranged, purchase limits are exceeded or fraud is reasonably suspected.

Price and payment

Prices are in Australian dollars and include GST where applicable unless stated otherwise. Delivery and any other payable charge are shown before order submission. If a clear pricing error is discovered before acceptance, we may cancel the affected item and refund any captured amount rather than supply at the incorrect price.

You authorise the selected provider to process payment. PayID and bank-transfer orders remain pending until cleared funds are received and matched. See Payment Options for payment security and refund information.

Changes and cancellation

Contact us immediately if you need to change or cancel an order. We will try to help but cannot guarantee a change once stock has been allocated, an item has been specially ordered or dispatch has started. A cancellation after dispatch may be treated as a change-of-mind return and reasonable return costs may apply.

We may cancel an accepted order where fulfilment becomes impossible for reasons outside reasonable control. If that happens, we will refund the amount paid for the unavailable product and applicable undelivered service.

Delivery, title and risk

Delivery choices, estimated timeframes, bulky-item conditions, access requirements and re-delivery rules are in our Delivery Information. Estimated dates are not guaranteed unless expressly agreed.

Ownership passes after full payment is received. Risk of accidental loss or damage passes when the product is delivered to the address or recipient nominated in the order, subject to rights that apply under the Australian Consumer Law.

Assembly, installation and safe use

You are responsible for checking site suitability and following all product instructions, warnings, load limits, maintenance requirements and applicable laws. Use appropriately qualified tradespeople where electrical, gas, plumbing, structural, anchoring, pool-safety or other regulated work is required.

Do not use a product that appears damaged, incomplete, unstable or unsafe. Contact customer care before further assembly or use.

Your statutory rights remain

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for reasonably foreseeable loss or damage. You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Liability

To the extent permitted by law, ZINSON is not responsible for loss caused by misuse, unauthorised modification, failure to follow instructions, unsuitable site conditions, customer-supplied information, third-party installation or events outside reasonable control.

Nothing in these terms limits liability or consumer rights where doing so would be unlawful. Where liability may lawfully be limited, it is limited to the remedies permitted by applicable law.

Intellectual property and third-party services

The website design, branding, text, graphics and other content are owned by or licensed to ZINSON and may not be reproduced commercially without permission. Product names and trade marks remain the property of their owners.

Links and services supplied by payment providers, carriers or other third parties may have separate terms. ZINSON is not responsible for third-party sites it does not control.

Governing law, changes and contact

These terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws. Courts and tribunals with jurisdiction may hear a dispute.

We may update these terms prospectively by publishing a revised version and date. The terms applying to an accepted order are those in effect when the order was submitted, except where a legal change must apply.

Definitions and interpretation

In these terms: “customer” and “you” mean the person using the website or named as purchaser; “product” means a physical item offered by ZINSON; “order” means an offer submitted through checkout; “order acknowledgement” means the automated message confirming receipt; and “business day” means a day other than Saturday, Sunday or a Victorian public holiday.

Headings help navigation and do not limit interpretation. Words such as “including” are not limiting. A reference to law includes amendments and replacements. If a policy linked in these terms conflicts with a non-excludable legal right, the legal right prevails.

Eligibility, accounts and authority

You must have legal capacity to place an order. If ordering for a business, organisation or another person, you confirm that you are authorised to provide the details, accept these terms and use the selected payment method.

You are responsible for accurate account and checkout information, keeping login details confidential and activity performed through your account. We may suspend or close an account where reasonably necessary to investigate fraud, security risk, abusive conduct or material breach. Closing an account does not erase payment, order or legal records that must be retained.

Products are offered for normal personal or business end use. We may apply reasonable quantity limits or decline orders that appear intended for unauthorised resale, export, market manipulation or circumvention of a promotion.

Promotions, discount codes and advertised offers

A promotion can have additional eligibility, product, region, quantity, date and redemption conditions. Those specific conditions form part of these terms for the promotion. Unless stated otherwise:

  • codes must be entered before order submission and cannot be applied retrospectively;
  • offers cannot be exchanged for cash or combined where the promotion says they are exclusive;
  • minimum-spend calculations exclude refunded, cancelled or ineligible products and may exclude delivery;
  • discounts apply only while stock or promotion allocation remains available;
  • obvious publication or system errors may be corrected before order acceptance.

We may withdraw or correct a promotion prospectively, but this does not remove rights attached to an order already accepted or any rights under the Australian Consumer Law.

Stock, backorders and purchase limits

Stock indicators are estimates based on systems and supplier information and can change before allocation. An item in a cart is not reserved merely because it has been added to the cart.

If an ordered product becomes unavailable, we may offer a delay, split shipment, suitable alternative or refund of the affected product. We will not substitute a materially different product without consent. Purchase limits may be applied fairly to scarce, promotional or safety-sensitive products.

Reviews, enquiries and customer content

If you submit a review, photo, question or other content for publication, you confirm that it is accurate to your honest experience, lawful, relevant, and does not infringe privacy, confidentiality, intellectual property or other rights.

You retain ownership of your content but give ZINSON a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it for store, customer-care and promotional purposes. This licence ends where content is deleted, except for lawful records, backups and material already incorporated into completed communications.

We may moderate or remove spam, abuse, secret personal information, unlawful claims, conflicts of interest or irrelevant content. We will not promise to publish every review and will not knowingly suppress genuine negative feedback merely because it is negative.

Product safety, recalls and regulatory notices

Follow safety warnings and stop using a product immediately if a serious defect or recall concern arises. We may contact purchasers using order details to communicate a recall, safety correction, replacement component or regulatory instruction.

You must not remove required labels, disable safety features or use products contrary to mandatory standards. Product categories such as pools, gas appliances, electrical goods, structures and children’s equipment may be subject to location-specific rules and professional installation requirements.

A safety recall or mandatory remedy is handled according to applicable law and the recall instructions, regardless of ordinary change-of-mind exclusions.

Customer conduct and support communications

We expect staff, contractors and customers to communicate respectfully. Threats, harassment, discriminatory abuse, deliberate falsehoods or repeated misuse of support channels may lead to communication limits or account restrictions, while preserving access reasonably needed for an existing order, safety issue or legal right.

We may keep accurate records of support communications for order handling, training, fraud prevention and dispute resolution in accordance with the Privacy Policy.

Website availability, errors and security

We aim to keep the website available and accurate but do not guarantee uninterrupted or error-free operation. Maintenance, hosting incidents, network failure, cyberattacks, browser incompatibility or third-party service outages can affect access.

You must not introduce malicious code, attempt unauthorised access, probe security, scrape at disruptive volume or interfere with checkout. We may block traffic or accounts where reasonably necessary to protect customers and systems.

If a technical error creates an incorrect order, payment or price display, contact us. We will investigate and provide the outcome required by the accepted contract and applicable law.

Events outside reasonable control

Neither party is responsible for delay or failure caused by an event outside reasonable control to the extent the event prevents performance. Examples can include natural disaster, severe weather, fire, epidemic, industrial action, government restriction, border or road closure, carrier network failure, utility outage or major cyber incident.

The affected party must take reasonable steps to reduce the impact. If delay becomes substantial, we will communicate available alternatives. This section does not allow ZINSON to keep payment for products it cannot lawfully supply and does not remove Australian Consumer Law rights.

Dispute resolution

  1. Contact customer careProvide the order number, facts, supporting material and the outcome requested.
  2. Internal reviewWe will review relevant order, payment, delivery and communication records.
  3. Proposed resolutionWhere possible, we will explain the decision and any repair, replacement, refund or other action.
  4. External optionsYou may seek independent advice or contact the relevant consumer affairs, fair trading, tribunal or court body.

Nothing in this process prevents either party from seeking urgent relief or exercising a right that cannot lawfully be restricted.

General legal provisions

If a provision is invalid or unenforceable, it is read down to the minimum extent necessary or severed, and the remaining provisions continue. A delay in enforcing a right is not a waiver. A waiver must be clear and applies only to the particular circumstance.

You may not transfer an accepted order or contractual right without our consent where the transfer would materially affect fulfilment, fraud risk or legal obligations. ZINSON may transfer the business or engage suppliers and contractors, but remains responsible for obligations it cannot lawfully transfer.

These terms and the policies incorporated by reference record the agreement about the website and order, subject to product-specific written terms and non-excludable law. Electronic notices and records may be used where legally permitted.
